Right to Be Forgotten

Last updated: 8 May 2025

At Lumen Education, we are committed to respecting your privacy and data rights, including your right to request the deletion of your personal data, also known as the “Right to Be Forgotten”, in accordance with the UK General Data Protection Regulation (UK GDPR).

1. What is the Right to Be Forgotten?

Under Article 17 of the UK GDPR, individuals have the right to have personal data erased where:

  • The data is no longer necessary for the purpose it was originally collected;

  • You withdraw your consent (where processing was based on consent);

  • You object to the processing and there are no overriding legitimate grounds;

  • The data was unlawfully processed;

  • The data has to be erased to comply with a legal obligation;

  • The data was collected from a child for an online service.

This right is not absolute and may be subject to certain conditions and exemptions.

2. How to Make a Request

You may submit a Right to Be Forgotten request by contacting us via one of the methods below. Please include:

  • Your full name and contact information;

  • A clear description of the personal data you wish to be deleted;

  • Any relevant details that will help us identify your data.

We may request proof of identity to ensure the protection of your data and prevent unauthorised access or deletion.

3. What Happens Next?

Upon receiving your request, we will:

  • Acknowledge receipt of your request;

  • Assess whether we hold personal data about you;

  • Determine whether we are legally required or able to delete the data;

  • Respond within one month of receiving your complete request, in accordance with UK GDPR timelines.

If we are unable to comply with your request, we will explain why (for example, if there is a legal obligation to retain certain records).

4. Exceptions to Deletion

We may not be able to delete your personal data if it is required for:

  • Complying with a legal obligation;

  • Exercising or defending legal claims;

  • Performing a task in the public interest;

  • Archiving purposes in the public interest, scientific or historical research, or statistical purposes where erasure is likely to render impossible or seriously impair the achievement of the objectives of that processing.
